Christopher Mathew Yates was due to be in court Thursday morning, instead he's behind bars in Botetourt County.
The Commonwealth's Attorney has reached an agreement with the former teacher so that he will plead guilty to a felony in July.
The Troutville resident will be sentenced to three years, but will only serve six months under the agreement.
Once Yates gets out, he will be on probation and have to register as a sex offender.
