Lexington man indicted in wife's death

LEXINGTON, Va. (WDBJ7) Martin Luther Nicholas was indicted for malicious wounding and domestic assault, but not murder, by a Rockbridge grand jury.

Nicholas' wife, Deborah, was found dead in April after police responded three early morning calls about loud fighting at their house. However, the medical examiner testified at a preliminary hearing that she could not identify either the cause or manner of Deborah Nicholas' death.

The Commonwealth's Attorney says, barring new evidence, he does not expect Martin Luther's charges to be upgraded to homicide.
