DANVILLE, Va. (WDBJ7) A man accused of abducting his biological daughter from Danville last month has waived extradition from North Carolina, where he has been jailed since his capture.

Carl Kennedy was arrested June 5. His daughter, Emma Grace, was the subject of an Amber Alert because Kennedy did not have custody of the child. The child was safely located at the time of Kennedy's arrest.

During a court hearing in Randolph County, North Carolina Wednesday, Kennedy's attorney said it would be best to resolve his matters in North Carolina before he is taken to Danville to face charges there.

Kennedy will be served with domestic assault and abduction arrest warrants for an incident that occurred in June at the Kwik Shop in Danville. Police say Kennedy assaulted Emma Grace's mother before disappearing with the child.

Kennedy will appear in a Randolph County court July 30. Once his court matters in North Carolina are resolved, Danville Police will have 30 days to pick Kennedy up and bring him to Virginia.
