LOS ANGELES (KTLA) -- Actress Halle Berry and her ex-boyfriend, Gabriel Aubry, were back in family court Monday, continuing a contentious custody dispute over their 3-year-old daughter.

Berry wants a judge to prohibit Aubry from having any contact with their daughter until a child endangerment investigation involving him is complete.

L.A. County Department of Children and Family Services recommended she and Aubry take parenting classes.

Neither Berry nor Aubry would comment outside court after the hearing.

Last week, Judge Scott Gordon heard the arguments, but didn't issue a ruling. He opted instead to wait for the regular judge handling the case to return from vacation.

Gordon did not grant an emergency order for either side, saying he believed there were enough protections in place to keep the couple's daughter Nahla safe.

Aubry, 36, is being investigated for battery and child endangerment.

Gordon ordered Monday's hearing closed to the media. The judge's ruling over Nahla's custody is sealed because Berry and Aubry are unmarried.

He is accused of pushing Nahla's nanny into a door while she was holding the girl.

According to a police report, Aubry was supposed to drop Nahla off at school, but when the nanny went to pick her up later in the day, she was told Nahla was not there.

The nanny, Alliance Kamdem, then went to Aubry's home to ask him about not taking Nahla to school.

Aubry allegedly launched into a tirade, which included a racial slur, and then pushed Kamdem as she held Nahla.

Kamdem's request for a restraining order against Aubry was denied last Tuesday.

In her declaration, Kamdem cited another alleged incident from last June, when she claims Aubry violently pushed her out the door.

She also claims Aubry did not like her from the moment she started the position.

Kamdem says he called her a spy, and said Nahla did not like her, according to court documents.

Aubry is also asking for a restraining order. He wants the judge to fire the nanny, claiming she is making up stories to win favor with Berry.

Berry and Aubry began dating in November 2005.

Berry gave birth to Nahla Ariela Aubry on March 16, 2008.

The couple split in April 2010.
