AMHERST, Va. -

An Amherst County murder case is going cold again, now that charges have been dropped against a prime suspect.

A judge dismissed Alex Valerio's case, following a preliminary hearing Thursday.

He was accused of killing Phillip James in January 2004, and dumping his body along River Road in Madison Heights.

Witnesses testified to seeing James and and Valerio together on the day of the killing, but a judge ruled there wasn't enough evidence to tie Valerio to the crime.
