Wednesday night, the Washington Post is reporting federal prosecutors may very well charge Governor McDonnell and his wife once the governor leaves office next month.

The charges are related to the gift giving scandal involving dietary supplement company Star Scientific.

The paper says federal prosecutors told the First Family last week they intend to charge them.

McDonnell's lawyers got the Justice Department to put it off.

That would allow McDonnell to avoid becoming the first sitting Virginia governor in state history to face criminal charges.

He has since given all the gifts and money back.
