CHARLOTTESVILLE, Va. -

A Charlottesville judge is allowing a civil suit filed in connection to the death of Morgan Harrington to move forward.

The Harrington’s filed a civil suit against Regional Marketing Concepts Incorporated back in March 2013.

The family claims the company that provided the security at John Paul Jones Arena the night Harrington went missing was negligent.

On Tuesday, Judge Jay Swett moved in favor of the Harrington family and said the company might have been negligent on October 17, 2009. That’s when security would not allow the Virginia Tech student to come back in to a Metallica concert.

The Harrington family is suing RMC for $3.9 million.
