Assault charges formally dropped against Botetourt school teacher

A judge has dismissed the charges against a Botetourt County teacher, accused of assaulting a student. Circuit Court Judge Michael Irvine signed the order Wednesday.   

Victor Terry appealed the case after he was found guilty earlier this month.   

The Lord Botetourt High School teacher supposedly grabbed a student to stop him from walking into a classroom.
   

The special prosecutor in the case, Don Caldwell asked for the charges to be dropped earlier this week saying the teacher didn't commit a crime.

The school superintendent, Dr. Tony Brads says Terry will return to the classroom Friday.
   

He'd been on paid administrative leave pending the outcome of the case.
