Charges against David Leon Mitchell have been upgraded.
After consulting with the Commonwealth's Attorney, Mitchell is being charged with first-degree murder and use of a firearm in commission of murder. Both are felonies.
Mitchell, 64, is charged in connection to the shooting death of his wife, Linda Mitchell.
She was 56.

A Bassett woman who was shot by her husband Tuesday died from her injuries Thursday.
Linda Mitchell was 56. She died at Wake Forest Baptist Medical Center where she was airlifted to after the shooting.
Her husband, David Mitchell, is being held without bond on felony charges related to her death.
The shooting happened Tuesday evening on Bittersweet Drive.

A Bassett woman is in critical condition after being shot by her husband Tuesday night.
Linda Sue Mitchell, 57, was airlifted to Wake Forest Baptist Medical Center to be treated for her injuries. Her husband, David Leon Mitchell, 64, has been charged with aggravated malicious wounding and use of a firearm in commission of a felony. Mitchell is being held in the Henry County Jail without bond.
The incident happened around 11:15 p.m. Tuesday on Bittersweet Drive.
