A Blacksburg attorney facing drug and gun charges will stay in jail.
Joseph Painter was denied bond during a hearing Monday.
He was arrested Feb. 26 in a hotel parking lot in Christiansburg. Painter, 65, has also been charged with DUI.
On Monday Painter was taken into court in a wheelchair. His attorney, Wade McNichols, says Painter has not been feeling well because of medication issues. Painter’s attorney argued that he should be released to the care of his wife.
The special prosecutor in the case, Joan Ziglar of Martinsville, argued that Painter is a danger to the community and to himself.
The hearing took an hour-and-a-half.

A well-known lawyer from Montgomery County is in jail.
Turns out a deputy from Montgomery County and an officer from the Christiansburg Police department answered the same call Tuesday night about two people fighting.
They pulled into the parking lot of a motel in Christiansburg, and found two people inside a car.
Joe Painter, a long-time and well-known criminal lawyer from Blacksburg, was charged with DUI, possession of a controlled substance and two counts of giving a firearm to a convicted felon.
Police say that convicted felon is 21-year-old Doris Ann Oliver, who was sitting in the car with Painter.
She's charged with seven counts, from drug possession to illegal possession of a firearm. She's a convicted felon so she's not allowed to have a weapon.
On the web, Painter says he's practiced law at the state and federal level, and that he makes it a habit to visit his clients in jail.
"Well I want folks to understand that I've had to step away from this case and ask the judge to appoint a special prosecutor here and again that’s in fairness to Mr. Painter, just like anybody else that would have charges that we deal with regularly,” Montgomery County Commonwealth’s Attorney Mary Pettitt said.
Joe Painter remains in the Montgomery County Jail. The magistrate has turned down his request to bond out.
12:30 p.m. Wednesday: A Blacksburg attorney was charged Tuesday with driving under the influence, and is facing additional drug distribution and gun charges.
Joseph Painter, Jr., 65, was arrested on a DUI charge by the Montgomery County Sheriff’s Office around 11 p.m. Tuesday, according to the Montgomery County Commonwealth’s Attorney office. Painter has also been charged with one count of distribution of a schedule IV controlled substance and two counts of selling or giving a firearm to a convicted felon.
Painter and another woman, Doris Oliver, were found together in a vehicle in a hotel parking lot on Laurel Street in Christiansburg, according to police. Police were originally called to the area after someone reported a possible fight between two people inside of a vehicle.
Oliver, 21, has been charged with two counts of possession of a firearm by a convicted felon, one count of possession of ammunition for a firearm by a convicted felon, one count of possession of a controlled substance, one count of possession of controlled paraphernalia, one count of marijuana possession, and one count of possession of a concealed weapon.
A special prosecutor, Joan Ziglar, of Martinsville, has been appointed by the Circuit Court to prosecute the case.
Painter is currently held in jail without bond.
