It's full steam ahead for a Norfolk Southern rail yard in Montgomery County.

Virginia's Supreme Court has ruled the state can help pay for the project.

This decision by the Virginia Supreme Court has neighbors in Elliston feeling like they've lost the fight.

Fomoso Worrell lives across the road.

“We all against it. We went and contested it and I don't think that it's right that us taxpayers has taxpayers has got the bill but yeah it's coming,” Worrell said.

Worrell and his family have lived in this home for 23 years.  He believes he'll lose his home as well but isn't going to worry about it until that day arrives.

“Well I'm going to stay here as long as I can.  Home is home,” Worrell said.

He and other neighbors have opposed it from the very beginning.

 “Better a good fight than it is a forced hand I reckon,” said Mickey Apgar.

Montgomery County's position on the rail yard has remained the same over the years.

The county doesn't believe state tax dollars should be used to fund the private intermodal yard planned by Norfolk Southern.

“The biggest concern was simply the fact that it was a decision to put a facilty in what the county board felt was the wrong place in Montgomery County,” Montgomery County Administrator Craig Meadows said.

Said Apgar: “To me it's a sad thing when the government or the railroad forces something on you that you don't want. but it'll work out. God's always looked after us and he's looking after us now.”

Meadows says the decision is disappointing to the county - yet they respect it.

He didn't want to speculate on what's next.

Norfolk Southern didn't have a comment on the lawsuit.

We're told construction depends on market conditions and there's no timetable right now.
