Tape of Virginia Tech shooter's hearing destroyed

An audio tape of Virginia Tech shooter Seung-Hui Cho has been destroyed.

Lawyers for two of the students killed in the shootings had requested a tape from the shooter's 2005 civil commitment hearing.

But Montgomery County court officials say the recording was likely destroyed in 2009.  State law requires such records to be kept just three years.

Cho appeared before a magistrate nearly three years before the shootings and was ordered to undergo outpatient counseling.

The parents of Erin Peterson and Julia Pryde have 10 million dollar lawsuits against the school.  A jury trial is set to begin in September.
