Virginia Tech football kicker released from jail
He won't be in New Orleans with the football team, but Cody Journell will be out of jail.

Journell was released on a $100,000 secured bond from the Montgomery County jail Wednesday morning.

He's been in jail since getting arrested for breaking and entering with a deadly weapon, last Wednesday.

Journell was the starting kicker for the Tech football team. He's been suspended indefinitely.

Two other co-defendants in the case, Matthew Brady and Matthew Dunton withdrew their motion for a new bond hearing, while they hire new attorneys.  They remain in custody.

The Judge said he granted Journell bond because he doesn't have a criminal record, he wasn't the one holding the weapon, and the victim in this case did not oppose his release.

The Judge ordered Journell to have no contact with the victim, to live at his parents house in Ripplemead, to be home by a 6pm curfew, to remain drug and alcohol free, and to enroll in pre-trial services.

His next court appearence is scheduled for February.

According to court testimony from the Commonwealth's attorney, Matthew Dunton walked up to the home of Dorenzo Hudson (a Tech basketball player) holding a pizza box.  Journell and Brady were hiding in the bushes. When Hudson opened the door, Dunton, Brady and Journell rushed inside the house. 

Dunton was holding what appeared to be a hand-gun, according to the prosecution. Dunton said he was "looking for someone," but when Hudson replied he was the only one in the house and threatened to call the police, the three men fled.

A driver was waiting in a car outside. He has not been charged with any crimes, but has given several statements to police. The driver told police the three men made a plan to confront Sean Allen, Hudson's roommate, and "settle a score" over stolen marijuana, according to courtroom statements.

Police later found the gun used in the breaking and entering on Route 460. The Commonwealth's attorney said it's been identified as a Crosman PRO77 BB Gun.

Police have said more charges could be pending in this case.
