ROANOKE, Va. (WDBJ) - A longtime Roanoke County School Board member is facing a criminal charge just weeks before Election Day.

Tim Greenway, who represents the Vinton District, has been charged with an election-related misdemeanor, according to court records.

The case stems from paperwork Greenway submitted earlier this year to get his name on the ballot. Candidates are required to collect voter signatures and file them with sworn affidavits. The county registrar flagged problems with Greenway’s petitions, including affidavits that were not filled out correctly and some duplicate signatures.

Greenway later corrected the issues, resubmitted his forms, and was approved for the ballot.

His attorney has called the errors unintentional, saying in a statement that Greenway “has taken complete responsibility for the mistakes that were on these forms.”

He continued by saying “there was no question regarding the accuracy of those who then and now supported him as reflected on the forms. Tim corrected the mistake and successfully resubmitted his forms. To his great credit, he has come together and resolved this matter. And Tim looks forward to continuing his remarkable service to the children of the Vinton District of the Roanoke County School Board and to all of his community.”

A Class 1 misdemeanor in Virginia is the most serious type of misdemeanor and carries penalties of up to one year in jail or a $2,500 fine. However, such a charge does not automatically disqualify someone from serving in office.

Greenway remains on the ballot for the November election. Early voting is already underway in the Vinton District.

A hearing in the case is scheduled for Oct. 16 in Roanoke County.
